Purpose of personal data processing and legal basis

1. Order of goods – conclusion of a purchase agreement and related actions – order processing, payment, delivery of goods, claiming liability for defects in goods, etc.
The legal basis for processing for the stated purpose is the performance of the contract – Article 6 (1) (b) of the Regulation.

2. Customer account – facilitating the ordering of goods and an overview of previous purchases
The legal basis for processing for the stated purpose is the consent of the data subject – Article 6 (1) (a) of the Regulation.

3. Marketing purposes – providing comprehensive information about the operator's products and services in the form of sending newsletters, by electronic means (email)

4. Cookies – ensuring the operation of the website and identifying customer and visitor behavior; tailoring marketing offers

5. Contact form – answering questions and resolving problems
The legal basis for processing for the stated purpose is the legitimate interest of the operator – Article 6 (1) (f) of the Regulation (the legitimate interest of the operator and also the (legitimate) interest of the contacting person in the processing of the personal data concerned arises from the goal of answering their questions or resolving emerging problems, and thereby maintaining and promoting the satisfaction of customers or users of the operator's website)

Retention period of personal data

The retention period of personal data is (i) for the time necessary to process and record your order (usually 4 years), (ii) for the duration of the customer account (if you create one), (iii) for the duration of registration for the newsletter (until unsubscribing from it) or handling your question/request, and (iv) in the case of other processing based on consent, until its withdrawal.

Information on the rights of data subjects

The data subject (the person whose personal data is processed) has the right:

  • to access data in accordance with Article 15 of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation) (hereinafter also "Regulation"), specifically (i) the right to obtain confirmation as to whether or not personal data concerning him or her are being processed, and, where that is the case, access to the personal data and (ii) information about the purposes of the processing, the categories of personal data concerned, the recipients or categories of recipients to whom the personal data have been or will be disclosed, in particular recipients in third countries or international organisations, where possible, the envisaged period for which the personal data will be stored, or, if not possible, the criteria used to determine that period, the existence of the right to request from the controller rectification or erasure of personal data or restriction of processing of personal data concerning the data subject or to object to such processing, the right to lodge a complaint with a supervisory authority, where the personal data are not collected from the data subject, any available information as to their source, the existence of automated decision-making, including profiling, referred to in Article 22(1) and (4) of the Regulation and, at least in those cases, meaningful information about the logic involved, as well as the significance and the envisaged consequences of such processing for the data subject, (iii) the right to be informed of the appropriate safeguards pursuant to Article 46 of the Regulation relating to the transfer if personal data are transferred to a third country or international organisation, (iv) the right to obtain a free copy of the personal data undergoing processing (for any further copies requested by the data subject, the controller may charge a reasonable fee based on administrative costs; where the data subject makes the request by electronic means, the information shall be provided in a commonly used electronic form, unless otherwise requested by the data subject) – the right to obtain such a copy must not adversely affect the rights and freedoms of others.
  • to rectification of personal data pursuant to Article 16 of the Regulation, without undue delay, and the right to have incomplete personal data completed pursuant to the cited article of the Regulation, including by means of providing a supplementary statement.
  • to erasure of personal data (right to be forgotten) pursuant to Article 17 of the Regulation, without undue delay, and provided that (i) the personal data are no longer necessary in relation to the purposes for which they were collected or otherwise processed, (ii) the data subject withdraws consent on which the processing is based according to Article 6(1)(a) or Article 9(2)(a) of the Regulation, and where there is no other legal ground for the processing, (iii) the data subject objects to the processing pursuant to Article 21(1) of the Regulation and there are no overriding legitimate grounds for the processing, or the data subject objects to the processing pursuant to Article 21(2) of the Regulation, (iv) the personal data have been unlawfully processed, (v) the personal data have to be erased for compliance with a legal obligation in Union or Member State law to which the controller is subject, (vi) the personal data have been collected in relation to the offer of information society services referred to in Article 8(1) of the Regulation; the foregoing shall not apply if the processing of personal data is necessary for reasons defined in Article 17(3) of the Regulation.
  • to restriction of processing of personal data pursuant to Article 18 of the Regulation, if (i) the accuracy of the personal data is contested by the data subject, for a period enabling the controller to verify the accuracy of the personal data, (ii) the processing is unlawful and the data subject opposes the erasure of the personal data and requests the restriction of their use instead, (iii) the controller no longer needs the personal data for the purposes of the processing, but they are required by the data subject for the establishment, exercise or defence of legal claims, (iv) the data subject has objected to processing pursuant to Article 21(1) of the Regulation pending the verification whether the legitimate grounds of the controller override those of the data subject.
  • to data portability pursuant to Article 20 of the Regulation – the data subject has the right to receive the personal data concerning him or her, which he or she has provided to a controller, in a structured, commonly used and machine-readable format and have the right to transmit those data to another controller without hindrance from the controller to which the personal data have been provided, (i) if the processing is based on consent pursuant to Article 6(1)(a) or Article 9(2)(a) of the Regulation or on a contract pursuant to Article 6(1)(b) of the Regulation, and (ii) if the processing is carried out by automated means.
  • to object to processing of personal data pursuant to Article 21 of the Regulation – The data subject has the right to object, on grounds relating to his or her particular situation, at any time to processing of personal data concerning him or her which is based on Article 6(1)(e) or (f) of the Regulation, including profiling based on those provisions. The controller shall no longer process the personal data unless the controller demonstrates compelling legitimate grounds for the processing which override the interests, rights and freedoms of the data subject or for the establishment, exercise or defence of legal claims.
  • If personal data are processed for direct marketing purposes, the data subject shall have the right to object at any time to processing of personal data concerning him or her for such marketing, which includes profiling to the extent that it is related to such direct marketing.
  • to withdraw his or her consent at any time, if the processing is based on Article 6(1)(a) or Article 9(2)(a) of the Regulation; the withdrawal of consent shall not affect the lawfulness of processing based on consent before its withdrawal.
